1. General
The following general terms and conditions apply to all contracts, deliveries and other services. Differing rules of the contractor, we hereby expressly oppose. All subsidiary agreements require our written confirmation.
1.2 The range is offered subject to change, art, play & fun (owner Holger Härtel) reserves the right to conclude a contract in individual cases. Small deviations and technical changes compared to our pictures or descriptions are possible. In the event of typing and calculation errors on the website, kunst-spiel-und-spass.de is entitled to withdraw, claims for damages are excluded in this case.
2 Time of conclusion of the contract
By clicking the button "Send order" you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order follows immediately after the order has been sent. The purchase contract is concluded with our order confirmation or delivery of the goods.

The contract text is saved. You can view the general contract terms at any time on this page. For security reasons, your specific order data cannot be accessed online.

You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

You can use the attached sample cancellation form, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication regarding your right of cancellation before the cancellation period expires.

Consequences of withdrawal

If you withdraw from this contract, we have made all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you chose a different type of delivery than the cheapest standard delivery we offer have) to repay immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract.
For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.
We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you inform us of the cancellation of this contract.
The deadline is met if you send off the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the nature, properties and functionality of the goods.

5 Warranty
The warranty is based on the statutory provisions, whereby in the event of a defect in the goods, we will either deliver or repair at your choice. If the rectification fails or if the delivered goods are also defective, you can return the goods against a refund of the full purchase price or keep the goods and reduce the purchase price after consultation with us. Information about any manufacturer warranties, please refer to the product documentation. The rights of the buyer due to a defect are excluded if he knows the defect when the contract is concluded.
5.1 Upon arrival, the customer must immediately inspect the goods for defects and condition. In the event of complaints, if you are clearly recognizable, you must, provided that you have purchased the goods as an entrepreneur. The guarantee does not extend to normal wear and tear. If the seller's or manufacturer's operating and goods instructions are not followed, products are used for purposes other than those intended, changes are made to the products, parts are replaced or accessories are used that do not meet the original specification, the warranty expires. It is the responsibility of the buyer to inform the seller about this. No guarantee is given for damage caused by the consumer through negligence or willful misconduct.
5.2 Warranty claims by the manufacturer that go beyond our warranty claims must be made directly to the manufacturer.
 
6 Delivery and payment
 
The delivery and payment terms of Kunst, Spiel & Spass (Inh. Holger Härtel) are specified in the order form. There is no minimum order quantity. Special delivery forms requested by our customers will be charged with a local surcharge. The expected delivery time can be found in the product description. If no information is given there, delivery will take place upon acceptance of the order, provided the goods are in stock, within 48 hours after receipt of the money in our account. The arrangement of longer delivery times at your request is possible. We are entitled to make partial deliveries to a reasonable extent. Additional shipping costs only arise with an express agreement. Our invoices are due immediately and payable net without any deductions. Payment is only deemed to have been made when Art, Games & Fun (owner Holger Härtel) can dispose of the amount. In the event of a delay in payment, we are entitled to charge default interest at a rate of 5% above the bank's base rate in accordance with the Discount Reconciliation Act. If the purchased goods are refused, we are entitled to either insist on acceptance or to demand 20% of the purchase price as a lump-sum compensation for damages and expenses. If you cannot prove that the damage was minor.
7 delivery times
If goods are not available, you will receive a notification by email. We strive for subsequent delivery as soon as possible. If the non-observance of a delivery or service deadline is due to force majeure, industrial action, unforeseeable obstacles or other circumstances for which we are not responsible, the deadline is automatically extended for a reasonable time. If the impossibility of delivery is due to the inability of the manufacturer or our supplier, both we and the buyer can withdraw from the contract if the agreed delivery date is exceeded by more than 2 months. Claims for damages due to delay or impossibilities or non-fulfillment, unless we are responsible for them, are excluded.
8 prices
The prices are binding and are in euros from our Mannheim warehouse. They generally do not include freight and packaging. We reserve the right to change prices due to increases in raw material prices, currencies and wages as well as delivery options. All our prices include VAT at the current rate of 19%. and only apply to our shop and can differ with the prices in our shop.
9 liability
We can only be liable for damage that occurs during operation with products from our delivery program if they have been assembled or installed in accordance with the operating instructions and are used properly.
10 Passing of risk
The risk passes to the buyer upon delivery.
11 Retention of title
The delivered goods remain the property of Kunst, Spiel & Spass (owner: Holger Härtel) until all claims of the seller against the customer have been paid in full. In the event of attachment or other intervention by third parties, the buyer must immediately notify us in writing.
12 Right of retention
The company Kunst, Spiel & Spass (owner: Holger Härtel) has a right of retention on the ordered goods until all claims from previous sales contracts have been settled, including claims related to or resulting from the sales contracts.

13 Data protection declaration
We only use your inventory data to process your order. We store and process all customer data in compliance with the relevant provisions of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG). You have the right to free information, correction, blocking and deletion of your stored data at any time. Please contact us or send us your request by post or fax. We will not pass on your personal data, including your home address and email address, to third parties. This does not apply to our service partners who need the transmission of data for order processing (e.g. the shipping company responsible for delivery and the credit institution responsible for payment processing). In these cases, however, the scope of the transmitted data is limited to the minimum necessary. In this shop, information about your customer data is stored in the cookies only at your request, which can then be called up on your next visits. The data stored in a cookie makes it unnecessary for you to repeatedly fill out the forms. You can manage the acceptance of cookies from this page in your browser program and block them if necessary.
14 place of jurisdiction
The lawsuit against the consumer can only be brought before the courts of the member state, within the jurisdiction of the consumer. If there are full merchants at the contractual partner, the place of jurisdiction is Ludwigshafen / Rhein.
